Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Waylore mobile application and website (collectively, the "Service") operated by Exerlyze UG (haftungsbeschränkt) ("we", "us", or "our").

By creating an account, downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description

Waylore is an AI-powered trip planning application that helps you:

Discover points of interest and activities
Generate personalized travel itineraries
Chat with an AI assistant for trip-related questions
Organize and manage your travel plans

To access certain features of the Service, you must create an account. You may sign in using email-based authentication (such as a one-time passcode or sign-in link), Google, or Apple, depending on the options made available in the app. You agree to provide accurate information and to keep your account credentials and device access secure.

3.2 Account Responsibility

You are responsible for activities that occur through your account, except to the extent caused by our own breach of duty. You must notify us without undue delay if you believe your account has been accessed without authorization.

3.3 Age Requirement

You must be at least 16 years old, or the minimum age required by applicable law in your place of residence, to use the Service.

4. Subscriptions and Payments

4.1 Free and Paid Plans

Waylore may offer a free plan and one or more paid subscription plans. Features and limits may differ by plan and may include trip length, trip generation limits, AI chat limits, access to historical trips, and other functionality. We may change plan features, limits, or availability from time to time.

4.2 Store Billing

Paid subscriptions are purchased through the Apple App Store or Google Play Store, as applicable. Prices, billing intervals, taxes, and the specific benefits of a paid plan are shown at the time of purchase. Your purchase is also subject to the terms and policies of the relevant app store.

4.3 Renewals and Trials

If a subscription is offered on a recurring basis, it renews automatically unless canceled through your app store account before renewal, subject to the rules of the relevant store. If a free trial or introductory offer is made available, the applicable terms will be shown to you at the time of purchase.

4.4 Cancellation and Refunds

You may manage or cancel your subscription through your Apple App Store or Google Play Store account settings. Deleting the app or deleting your Waylore account does not by itself cancel an active subscription. Refunds, if any, are handled by the relevant app store under its policies.

5. Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Use the Service to submit unlawful, infringing, abusive, or malicious content
Attempt to circumvent usage limits or security measures
Attempt to manipulate, probe, or interfere with the Service's AI systems, security controls, or rate limits
Share your account credentials with others
Use automated tools to access the Service (bots, scrapers)
Interfere with the Service's operation or infrastructure
Use the Service to plan activities that are illegal in your destination

6. AI-Generated Content

6.1 Nature of the Service

Waylore uses artificial intelligence to generate travel itineraries and answer trip-related questions. AI-generated output is informational only and may be incomplete, inaccurate, outdated, unavailable, or unsuitable for your needs.

6.2 No Booking or Travel Agency Services

Waylore is not a travel agency, tour operator, carrier, booking agent, or provider of transportation, lodging, restaurant, or attraction services. Unless explicitly stated otherwise, we do not make bookings or reservations on your behalf and do not guarantee the availability of any third-party service.

6.3 Your Responsibility to Verify

You are responsible for verifying important information before relying on it, including opening hours, prices, availability, reservation requirements, accessibility, transit schedules, weather, local laws, visa or entry requirements, and safety conditions. You are solely responsible for your travel decisions and for complying with applicable laws and regulations.

6.4 AI Disclaimer

AI-generated suggestions do not constitute professional travel, legal, medical, safety, or other professional advice. To the extent permitted by law, we are not responsible for losses caused by reliance on AI-generated output that you did not independently verify.

7. Points of Interest, Maps, and Third-Party Content

7.1 Third-Party Data and External Content

The Service may display points of interest, summaries, images, websites, opening hours, map data, and other content obtained from third-party providers, public databases, or external websites. Such content may be incomplete, inaccurate, outdated, or unavailable and is provided on an "as is" basis.

7.2 External Links and Third-Party Services

The Service may link to third-party websites or services. We do not control and are not responsible for third-party content, products, services, or terms. Your use of third-party services is governed by the terms and privacy policies of those third parties.

7.3 Maps and Location Features

If you enable location permissions, the Service may use your device location to support map and trip features. Location and map features may be inaccurate, interrupted, delayed, or unavailable and must not be relied on for emergency, safety-critical, or precise navigation purposes.

7.4 Attribution

Certain map and points-of-interest data are provided under third-party licenses, including OpenStreetMap and related sources. Third-party licensors retain their respective rights.

8. Intellectual Property and User Content

8.1 Our Rights and Limited License to You

The Service, including its software, design, branding, and original content, is owned by Exerlyze UG (haftungsbeschränkt) or its licensors and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal, non-commercial use in accordance with these Terms and any applicable app store rules.

8.2 Your Content

You retain ownership of the content you submit to the Service, including trip names, preferences, itinerary edits, chat messages, feedback, and reports ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, and process your User Content as necessary to operate, secure, maintain, and support the Service, including by using service providers and AI providers acting on our behalf, in each case subject to our Privacy Policy.

8.3 Responsibility for User Content

You are responsible for your User Content and for ensuring that you have the rights necessary to submit it. We may remove or restrict access to User Content that violates these Terms, applicable law, or the rights of others.

8.4 Feedback

If you provide feedback or suggestions about the Service, we may use them without restriction or obligation to you.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

10. Account Suspension, Termination, and Deletion

10.1 By You

You may delete your account through the app settings or as otherwise described on our Data Removal page. Deletion will remove or anonymize your data as described there and in our Privacy Policy. We may retain limited information where required by law or reasonably necessary for security, fraud prevention, legal claims, accounting, or app-store purchase records that are controlled by the relevant store rather than by us.

10.2 By Us

We may suspend or terminate your access, or limit certain features, if you materially violate these Terms, misuse the Service, attempt to bypass limits or security controls, engage in fraudulent or abusive conduct, scrape or automate access in violation of these Terms, or use the Service in a way that creates risk for us, other users, or third parties.

10.3 Effect of Termination

Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, liability, disputes, and other accrued rights or obligations.

11. Service Changes

We may modify, update, suspend, or discontinue the Service, or any feature, model, provider, destination coverage, plan, or usage limit, from time to time. Where required by law, we will provide notice of material changes. If you continue using the Service after a change takes effect, you agree to the updated Terms. If you do not agree, you must stop using the Service and, if applicable, cancel your subscription through the relevant app store.

12. Liability

12.1 Mandatory Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent, gross negligence, injury to life, body, or health, fraudulent concealment, or liability under mandatory product liability law.

12.2 Liability for Slight Negligence

In cases of slight negligence, we are liable only for breaches of essential contractual obligations whose performance is necessary for the proper provision of the Service and on which you may ordinarily rely. In such cases, our liability is limited to the foreseeable damage typical for this type of contract.

12.3 Excluded Losses

Subject to Sections 12.1 and 12.2, we are not liable for losses resulting from inaccurate or outdated AI-generated or third-party information, travel disruptions, missed reservations, missed connections, lost profits, lost savings, loss of goodwill, or indirect or consequential damages.
